Terms & Conditions
Version 1.1
These Terms & Conditions apply to all photography and videography services provided by Connor Alan Visuals unless otherwise agreed in writing.
1. Booking Confirmation
A booking is considered confirmed once the Client has accepted a quotation or otherwise confirmed the booking in writing (including email or written message).
By confirming a booking, the Client confirms that they have had the opportunity to read and accept these Terms & Conditions.
2. Booking Deposits
Where a booking deposit is requested, the booking is not secured until the deposit has been received.
Unless otherwise agreed in writing, all booking deposits are non-refundable.
Deposits are deducted from the final invoice balance.
3. Coverage
The agreed:
Date
Arrival time
Finish time
Location
Services
will be confirmed within the Booking Confirmation.
Additional coverage beyond the agreed finish time may be available, subject to availability, and will be charged at the standard hourly rate unless otherwise agreed.
4. Travel
Travel within 20 miles of Huddersfield is included within the quoted price unless otherwise stated.
Any additional mileage, parking, toll charges or accommodation requirements will be agreed before the booking.
5. Rescheduling
If you need to make changes to your booking, please contact Connor Alan Visuals as soon as possible.
Where possible, every effort will be made to accommodate amendments to event dates, locations or timings. However, all amendments remain subject to availability.
More than 14 days before the event
Bookings may be rescheduled free of charge, subject to availability.
7–14 days before the event
Bookings may be rescheduled subject to availability. A 25% non-refundable booking deposit will be required to secure the new date. This deposit will be deducted from the final balance.
Less than 7 days before the event
Rescheduling requests may be treated as a cancellation and will be subject to the Cancellation Policy.
4. Cancellation Policy
Should you need to cancel your booking, please notify Connor Alan Visuals as soon as possible by emailing:
Cancellation charges are as follows:
More than 14 days before the event
No cancellation fee.
7–14 days before the event
50% of the agreed booking fee.
Less than 7 days before the event
100% of the agreed booking fee.
Weather-dependent outdoor shoots may be rearranged where reasonably possible.
6. Image Delivery
Edited photographs and/or video will be delivered within the turnaround time stated within your Booking Confirmation.
Content is delivered via FromSmash unless otherwise agreed.
Download links remain active for 30 days.
It is the Client's responsibility to download and safely store all delivered files before the download link expires.
Connor Alan Visuals cannot guarantee long-term storage once the download period has ended.
7. Image Editing
Images are edited in the Connor Alan Visuals style.
Minor amendments may be accommodated where reasonable.
Requests for extensive re-editing or additional editing may incur an additional charge.
RAW image files remain the property of Connor Alan Visuals unless otherwise agreed in writing.
8. Image Licensing
Upon receipt of full payment, the Client receives a perpetual, non-exclusive licence to use the delivered content for:
Social media
Websites
Marketing
Advertising
Printed promotional material
Images may not be:
Resold
Relicensed
Distributed to third parties
Submitted to stock libraries
without prior written permission.
9. Copyright
Copyright of all photographs and video remains with Connor Alan Visuals.
Connor Alan Visuals reserves the right to use images and video for:
Portfolio
Website
Social media
Awards
Marketing
Promotional purposes
Where confidentiality has been agreed before the event, this clause shall not apply.
10. Client Responsibilities
The Client agrees to:
Provide accurate booking information.
Inform Connor Alan Visuals of any venue restrictions.
Identify any essential photographs or video before the event.
Ensure any required permissions for photography or filming have been obtained.
Ensure Connor Alan Visuals has suitable access to the venue, including any passes, accreditation or permissions required.
11. Model Releases
Where commercial advertising requires identifiable individuals to appear in promotional material, the Client is responsible for obtaining any necessary permissions or model releases unless otherwise agreed.
12. Payment Terms
Invoices are issued following completion of the agreed work unless otherwise arranged.
Payment is due within 30 days of the invoice date.
Accepted payment methods are listed on each invoice.
Late payments may incur statutory interest and fixed compensation where applicable under the Late Payment of Commercial Debts (Interest) Act 1998.
13. Equipment Failure
Connor Alan Visuals maintains professional equipment and carries backup equipment wherever reasonably possible.
In the unlikely event of equipment failure, illness or unforeseen circumstances preventing attendance, every reasonable effort will be made to:
Arrange suitable replacement cover
Rearrange the booking
Agree an appropriate alternative solution
14. Safe Working
Connor Alan Visuals reserves the right to suspend or terminate coverage where working conditions become unsafe.
This includes, but is not limited to:
Violence
Threatening behaviour
Abuse
Illegal activity
Situations presenting genuine risk to personal safety
Where coverage is terminated for safety reasons outside the control of Connor Alan Visuals, this shall not constitute a breach of contract.
15. Force Majeure
Connor Alan Visuals shall not be liable for failure to perform services due to circumstances beyond reasonable control, including but not limited to:
Severe weather
Government restrictions
Venue closure
Illness
Natural disasters
Civil unrest
Transport disruption
16. Limitation of Liability
Whilst every reasonable effort is made to provide complete photographic and video coverage, Connor Alan Visuals cannot guarantee every requested image or moment due to circumstances beyond reasonable control.
To the fullest extent permitted by law, Connor Alan Visuals' total liability arising from any booking shall not exceed the total fees paid by the Client for that booking.
17. Data Protection
Personal information provided by Clients will be processed in accordance with applicable UK data protection legislation.
Information is collected solely for the purposes of:
Managing bookings
Delivering services
Communication
Invoicing
Legal and accounting obligations
Personal information will never be sold to third parties.
18. Amendments
Connor Alan Visuals reserves the right to amend these Terms & Conditions at any time.
The version applicable to a booking will be the version in force at the time the booking was confirmed.
19. Governing Law
These Terms & Conditions shall be governed by the laws of England and Wales.
Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
